The terms and conditions that govern your use of the Certified Email and Certified Notification services.

1. Who we are and acceptance of these terms

Advanced Email Technologies ("Advanced Email Technologies", "we", "us", "our"), registered at Via Stoppani 13, 24121 Bergamo, Italy, operates the Certified Email and Certified Notification services and the website at certifiedemail.pro (together, the "Service"). These Terms of Service ("Terms") form a binding agreement between you and Advanced Email Technologies. By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation, and "you" refers to that organisation as well as to you personally.

2. Definitions

  • "Certified Email" means our service that provides SMTP delivery confirmation and a cryptographic fingerprint (hash) of a message's content and attachments.
  • "Certified Notification" means our service for sending a notification email containing a secure link to a certified PDF document, which requires recipient identity confirmation before the document can be viewed.
  • "Certificate" means the PDF record we generate documenting delivery, content hash, identity confirmation (where applicable), viewing, and independent timestamps for a given message.
  • "Account" means the registered user account through which you access and manage the Service.
  • "Content" means the messages, attachments, PDF documents, and recipient data you submit through the Service.

3. The Service

3.1 Certified Email

Certified Email lets you send a message from your own email account or address, adding our domain so that it is relayed through our infrastructure. We record the exact content and attachments of the message, generate a SHA-256 fingerprint of that content, capture the verbatim SMTP acceptance response from the recipient's mail server, and obtain an independent RFC 3161 timestamp. This data is compiled into a downloadable Certificate.

3.2 Certified Notification

Certified Notification lets you upload a PDF document, specify the recipient's expected identifying details, and send a notification email containing a secure link. The recipient must enter identity details matching those you specified before the document becomes viewable. Delivery, identity confirmation, each view, and each download are separately recorded, each with its own hash and independent timestamp, and compiled into a Certificate.

We provide the technical infrastructure to generate, transmit, and record this evidence. We are not a party to, and do not review, approve, or take responsibility for, the substance of the communications you send through the Service.

4. Eligibility and your account

The Service is intended for business and professional use by adults. You must be at least 18 years old and have the legal capacity to enter into a binding contract to create an Account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. Notify us immediately at privacy@certifiedemail.pro if you suspect unauthorised use of your Account.

You must provide accurate registration and billing information and keep it up to date.

5. Free trial, pricing, and payment

New accounts receive two free certified sends so you can review a full Certificate before paying. Beyond the free trial, the Service is available through prepaid packages (for example, 10 Certified Emails or 10 Certified Notifications for a fixed price) or on a pay-as-you-go basis charged per message, as described on our Pricing page. Prices are shown in the currency displayed at checkout and may be updated from time to time; changes apply to purchases made after the change takes effect.

Prepaid packages do not expire and may be renewed or topped up at any time. Fees are payable in advance of use. Except where required by applicable law, fees already paid for certified sends are non-refundable once a message has been processed, since the certification service is fully performed at the moment of sending. Payment card and billing details are collected and processed by our third-party payment processor, as described in our Privacy Policy.

You are responsible for any taxes applicable to your purchase, other than taxes on our net income.

6. Your responsibilities and acceptable use

You are solely responsible for the Content you submit and for having the legal right to send it, including the right to communicate with the intended recipients. You agree not to use the Service to:

  • —send unsolicited bulk email, spam, or content violating applicable anti-spam law;
  • —send content that is unlawful, defamatory, harassing, threatening, or infringes a third party's rights, including intellectual property, privacy, or data protection rights;
  • —send malware, phishing content, or content intended to deceive a recipient about the sender's identity;
  • —submit recipient identity data for Certified Notification that you know to be false or that you are not authorised to process;
  • —attempt to reverse-engineer, probe, or circumvent the security or integrity of our certification, hashing, or timestamping processes; or
  • —use the Service in a manner that violates any applicable law, including data protection law applicable to the personal data of recipients.

Where the Content you send includes personal data of a recipient or a third party, you act as the data controller for that data and are responsible for having a valid legal basis for processing and transmitting it. Our role in relation to that Content is described in our Privacy Policy.

We may investigate suspected violations of this section and take the actions described in Section 15.

7. Certificates and their evidentiary value

Certificates document the technical facts we independently observe: SMTP delivery responses, content hashes, identity-confirmation results, view and download events, and RFC 3161 timestamps issued by a third-party timestamping authority. We take reasonable technical measures to ensure this record is accurate and tamper-evident at the moment of creation.

In many jurisdictions, including under eIDAS Article 46 in the European Union and under ESIGN and UETA in the United States, electronic evidence cannot be denied legal effect or admissibility solely because it is in electronic form. However, we are not a court, regulator, or legal adviser, and we do not guarantee that any Certificate will be accepted as evidence, or given particular weight, in any specific proceeding, jurisdiction, or dispute. Admissibility and weight are ultimately determined by the relevant court, tribunal, or authority applying its own procedural rules. Nothing in the Service constitutes legal advice, and you should consult independent legal counsel regarding the evidentiary requirements of your specific situation.

8. Recipient data in Certified Notification

For Certified Notification, you specify identifying details the recipient must confirm before viewing the document. You are responsible for the accuracy of the identifying details you provide. We are not responsible for delivery or identity-verification failures caused by inaccurate information you supplied, nor for a recipient's inability or refusal to complete identity confirmation.

9. Intellectual property

We and our licensors own all right, title, and interest in the Service, including its software, design, and the Certified Email name and logo, excluding your Content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your own business purposes. You retain all rights in the Content you submit. By submitting Content, you grant us a limited licence to process, transmit, hash, timestamp, store, and reproduce it solely to provide, secure, and support the Service, including generating and reproducing your Certificates at your request.

10. Third-party services

The Service relies on third parties to operate, including hosting and infrastructure providers, payment processors, an independent RFC 3161 timestamping authority, and email delivery infrastructure authenticated via SPF/DKIM/DMARC. We select these providers with care, but we are not responsible for outages, errors, or acts or omissions of independent third parties outside our reasonable control.

11. Privacy and cookies

Our collection and use of personal data in connection with the Service is described in our Privacy Policy. Our use of cookies and similar technologies on this website is described in our Cookie Policy. Both are incorporated into these Terms by reference.

12. Service availability and changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features of the Service, including for maintenance, security, or legal reasons, and will use reasonable efforts to give advance notice of material changes affecting paid features where practicable.

13. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Certificates will be accepted by any specific court, regulator, or counterparty, or that the Service will meet your particular requirements.

To the maximum extent permitted by applicable law, Advanced Email Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the Service. Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or liability that cannot be limited under mandatory consumer-protection law applicable to you.

14. Indemnification

You agree to indemnify and hold Advanced Email Technologies harmless from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your Content, your breach of these Terms, or your violation of any applicable law or third-party right, except to the extent caused by our own breach of these Terms or applicable law.

15. Suspension and termination

You may stop using the Service and close your Account at any time. We may suspend or terminate your access to the Service, in whole or in part, if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or if required to do so by law, with notice where reasonably practicable in the circumstances. Sections that by their nature should survive termination — including Sections 7, 9, 13, 14, 16, and 18 — will continue to apply after your Account is closed.

Data retention following account closure, including the retention of Certificates and evidentiary records, is described in our Privacy Policy.

16. Governing law and jurisdiction

These Terms are governed by the laws of Italy, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rules that entitle you to bring proceedings in the courts of your own country of residence, you and Advanced Email Technologies submit to the exclusive jurisdiction of the courts of Bergamo, Italy, for any dispute arising out of or relating to these Terms or the Service.

17. Changes to these terms

We may update these Terms from time to time to reflect changes in the Service, our practices, or legal requirements. We will post the revised version on this page with an updated "Last updated" date and, where changes are material, notify registered users by email in advance of the change taking effect. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

18. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be interpreted to best reflect the parties' intent. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Advanced Email Technologies regarding the Service.
